1.Acceptance of Terms

By creating an account, accessing our website at braitha.com, or using any of our mobile game testing services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with any part of these terms, you must not use our services.

These terms constitute a legally binding agreement between you and Braitha, a technology company operating from Office # 02, 3rd floor, Azam tower, Arbab Rd, stop Peshawar, 25000, Pakistan. We reserve the right to modify these terms at any time, and continued use of our services after such modifications constitutes acceptance of the updated terms.

2.Service Description

Braitha provides a comprehensive mobile game testing platform that connects game developers with qualified testers. Our services include but are not limited to:

• Mobile game testing and quality assurance services
• Bug reporting and performance analysis tools
• User experience evaluation and feedback systems
• Testing project management and coordination
• Developer and tester matching services

We strive to maintain high service standards but do not guarantee uninterrupted availability or error-free operation of our platform. Service features may be updated, modified, or discontinued at our discretion with reasonable notice to users.

3.User Accounts and Registration

Account Creation

To access certain features of our platform, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Security

You must immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with these security obligations.

Account Suspension

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a security risk to our platform or other users.

4.User Conduct and Responsibilities

As a user of our platform, you agree to conduct yourself professionally and ethically. You are prohibited from engaging in the following activities:

• Harassing, threatening, or discriminating against other users

• Using our platform for illegal activities or purposes

5.Intellectual Property Rights

All content, features, and functionality on our platform, including but not limited to text, graphics, logos, software, and user interfaces, are owned by Braitha or our licensors and are protected by Pakistani and international copyright, trademark, and other intellectual property laws.

Users retain ownership of their original content but grant Braitha a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute such content as necessary to provide our services. Game developers retain ownership of their games but grant necessary permissions for testing purposes.

6.Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to our data practices as described in the Privacy Policy.

We implement industry-standard security measures to protect user data, but cannot guarantee absolute security. Users are responsible for maintaining the confidentiality of their account information and for any consequences resulting from disclosure of such information.

7.Payment Terms and Refunds

Payment Processing

All payments for our services are processed securely through third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method and agree to pay all charges incurred.

Refund Policy

Refunds are considered on a case-by-case basis for services not delivered as promised. Requests must be submitted within 30 days of the original transaction. We reserve the right to deny refund requests that do not meet our criteria or appear fraudulent.

8.Limitation of Liability

To the maximum extent permitted by applicable law, Braitha shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from your use of our services.

Our total liability for any claims arising from or relating to these terms or our services shall not exceed the amount paid by you to Braitha in the twelve months preceding the claim.

9.Dispute Resolution

Any disputes arising from these terms or your use of our services shall be resolved through binding arbitration in accordance with the laws of Pakistan. The arbitration shall take place in Peshawar, Pakistan, and shall be conducted in English.

Before initiating arbitration, parties must attempt to resolve disputes through good faith negotiation for a period of at least 30 days. This dispute resolution clause does not prevent either party from seeking injunctive relief in court for intellectual property violations or other urgent matters.

10.Modifications to Terms

We may update these Terms of Use periodically to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will notify users through email or prominent notices on our platform at least 30 days before the changes take effect.

Your continued use of our services after the effective date of any modifications constitutes acceptance of the updated terms. If you do not agree with the modified terms, you must discontinue use of our services.

11.Termination

Either party may terminate this agreement at any time with or without cause. Upon termination, your right to use our services ceases immediately, though certain provisions of these terms will survive termination, including intellectual property rights, limitation of liability, and dispute resolution clauses.

We reserve the right to suspend or terminate accounts that violate these terms, engage in suspicious activity, or remain inactive for extended periods. Account holders will receive reasonable notice before termination unless immediate action is required for security or legal reasons.

12.Governing Law

These Terms of Use are governed by and construed in accordance with the laws of Pakistan, without regard to conflict of law principles. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts of Peshawar, Pakistan.
